This Privacy Policy explains how Advisentra ("Advisentra", "we", "us", "our") collects, uses, stores, and protects personal data in connection with the Advisentra business management platform available at https://advisentra.co.uk (the "Service"). It applies to visitors to our website, customers who register for an account, and individuals whose data our customers store within the Platform, such as their own customers and employees. By using the Service, you acknowledge that you have read and understood this Policy.

1. Who We Are

Advisentra provides web-based business management software for small businesses, freelancers, sole traders, consultants, and service-based businesses, covering customer records, sales, invoicing, payments, projects, tasks, and employee management. For the purposes of applicable data protection law, Advisentra acts as the data controller in respect of account and billing information relating to our direct customers, and generally acts as a data processor in respect of the Customer Data that our customers input and store within the Platform on behalf of their own customers and employees, as described further in Section 8.

2. Information We Collect

2.1 Account and Billing Information

When you register for an account and subscribe to a plan, we collect information such as your name, business name, email address, and billing details. Payment card information is collected and processed directly by Stripe, our third-party payment processor, and is not stored on Advisentra's own servers.

2.2 Customer Data You Store on the Platform

As part of using the Service, you may input and store data relating to your own customers, leads, employees, projects, invoices, income, and expenses ("Customer Data"). This may include names, contact details, financial records, and, where relevant, employee records such as leave and onboarding information. This Customer Data belongs to you, and we process it on your behalf and in accordance with your instructions, as described in Section 8.

2.3 Technical and Usage Information

We automatically collect certain technical information when you use the Service, including your IP address, browser type, device information, log data, and information about how you interact with the Platform. This helps us maintain, secure, and improve the Service.

2.4 Cookies and Similar Technologies

We use cookies and similar technologies to operate the Platform, remember your preferences, keep you securely logged in, and understand how the Service is used. You can control cookies through your browser settings; however, disabling certain cookies may affect the functionality of the Service.

3. How We Use Your Information

We use the information we collect for the following purposes:

  • To create and administer your account and provide access to the Service;
  • To process subscription payments through Stripe, including Bacs Direct Debit where applicable;
  • To provide customer support and respond to your enquiries;
  • To send you administrative communications, such as billing confirmations, service notices, and updates to our policies;
  • To maintain the security, integrity, and reliability of the Platform;
  • To understand how the Service is used, in order to improve and develop it;
  • To comply with our legal and regulatory obligations; and
  • With your consent, to send you marketing communications about Advisentra, which you may opt out of at any time.

4. Legal Basis for Processing

Where UK or EU data protection law applies, we rely on the following legal bases to process personal data: performance of a contract with you (to provide the Service you have subscribed to); our legitimate interests (such as maintaining and improving the Platform and keeping it secure); compliance with a legal obligation (such as tax and accounting record-keeping requirements applicable to us); and, where applicable, your consent (such as for optional marketing communications, which you may withdraw at any time).

5. Payment Processing and Stripe

All payments made through the Service, including subscription fees, are processed securely through Stripe. When you make a payment, your payment information is transmitted directly to Stripe and handled in accordance with Stripe's own privacy policy and security standards. Advisentra does not hold customer funds and does not store full payment card details on its own systems. We recommend reviewing Stripe's privacy policy for further information on how it processes payment data.

6. How We Share Information

We do not sell your personal data. We may share information in the following circumstances:

  • With Stripe, to process subscription and customer payments;
  • With service providers who support our infrastructure, such as hosting, storage, and technical support providers, under appropriate confidentiality and data processing agreements;
  • Where required by law, regulation, or a valid request from a public or governmental authority;
  • To protect the rights, property, or safety of Advisentra, our customers, or others; and
  • In connection with a merger, acquisition, or sale of business assets, subject to appropriate safeguards.

7. International Data Transfers

Where personal data is transferred outside the United Kingdom or European Economic Area, including to service providers such as Stripe or hosting providers located in other countries, we take steps to ensure appropriate safeguards are in place, such as relying on recognised legal mechanisms including standard contractual clauses, to help ensure your data continues to receive an appropriate level of protection.

8. Customer Data You Store: Your Responsibilities

Where you use Advisentra to store information about your own customers, leads, or employees, you act as the data controller for that Customer Data, and Advisentra acts as a data processor, processing that data only on your instructions and for the purpose of providing the Service. You are responsible for ensuring you have a lawful basis to collect and store this data within Advisentra, for providing appropriate notices to the individuals concerned, and for complying with your own obligations under applicable data protection law. Advisentra will process such Customer Data only in accordance with your instructions and this Policy, and will not use it for its own independent purposes.

9. Data Retention

We retain account and billing information for as long as your account remains active, and for a reasonable period afterwards to comply with legal, accounting, or reporting obligations, and to resolve disputes. Customer Data you store within the Platform is retained for as long as your account is active, and for a limited period following account termination to allow you to export your data, after which it may be permanently deleted in accordance with our standard data retention practices.

10. Data Security

We implement appropriate technical and organisational measures designed to protect personal data against unauthorised access, loss, misuse, or alteration, including access controls, encryption of data in transit, and secure handling of payment information via Stripe. While we take data security seriously, no method of transmission or storage is completely secure, and we cannot guarantee absolute security of information transmitted to or stored on the Platform.

11. Your Rights

Depending on your location, you may have certain rights in relation to your personal data, which may include the right to:

  • Access the personal data we hold about you;
  • Request correction of inaccurate or incomplete data;
  • Request deletion of your personal data, subject to certain exceptions;
  • Object to or restrict certain processing of your personal data;
  • Request a portable copy of your personal data; and
  • Withdraw consent, where processing is based on consent, at any time.

To exercise any of these rights, please contact us using the details in Section 15. If you have concerns about how we handle your personal data, you also have the right to lodge a complaint with the Information Commissioner's Office (ICO) or another relevant data protection authority.

12. Marketing Communications

Where you have consented to receive marketing communications from us, you may opt out at any time by using the unsubscribe link included in our emails or by contacting us directly. Opting out of marketing communications will not affect your receipt of essential service-related communications, such as billing notices or security alerts.

13. Children's Privacy

The Service is intended for business use by adults and is not directed at children. We do not knowingly collect personal data from children, and if we become aware that we have inadvertently done so, we will take steps to delete that information.

14. Changes to This Privacy Policy

We may update this Privacy Policy from time to time to reflect changes in our practices, the Service, or legal requirements. Where changes are material, we will provide reasonable notice, such as by email or a notice on the Platform, before the changes take effect. 16. Automated Decision-Making and Profiling

We do not use your personal data for automated decision-making that produces legal or similarly significant effects concerning you. Business reports and analytics generated within the Platform are intended to support your own decision-making and are not used by Advisentra to make automated decisions about you or your customers.

17. Third-Party Links and Services

The Platform may contain links to third-party websites or integrate with third-party services, such as Stripe for payment processing. This Privacy Policy does not apply to those third-party websites or services, and we encourage you to review their respective privacy policies before providing them with any personal data. We are not responsible for the privacy practices of third parties.

18. How We Collect Information From You

We collect information directly from you when you register for an account, subscribe to a plan, input Customer Data into the Platform, contact our support team, or otherwise interact with the Service. We also collect information automatically through your use of the Platform, such as log data and cookies, as described in Section 2. In limited circumstances, we may receive information from third parties, such as Stripe, in connection with the processing of a payment.

19. Employee Data Stored Within the Platform

Certain Advisentra plans allow businesses to store employee records, leave information, onboarding details, and employee documents within the Platform. Where you use these features, you are the data controller of that employee data, and you are responsible for ensuring you have appropriate legal grounds to process it, that your employees have been informed of how their data will be used, and that your use of the Platform for this purpose complies with applicable employment and data protection law. Advisentra processes this employee data solely as a data processor, in accordance with Section 8 of this Policy.

20. Data Minimisation

We aim to collect and retain only the personal data that is reasonably necessary to provide and improve the Service, meet our legal obligations, and support the purposes described in this Policy. Where possible, we design the Platform to allow you to control what Customer Data you choose to store within it.

21. Your Choices

In addition to the rights described in Section 11, you have a number of practical choices in relation to your personal data, including adjusting your browser's cookie settings, updating your account information directly within the Platform, choosing what Customer Data to store within Advisentra, and opting out of marketing communications at any time. If you no longer wish to use the Service, you may close your account, subject to the terms of our Terms and Conditions and applicable Refund Terms.
